General Information about non-government organization "Society and Right" Public Community

On the 19th of February, 2001 "Society and Right" Public Community was established and Agayev Amir Aga oglu was selected as a chairman. On the 30lh of March, 2001 It has been registered by the Ministry of Justice. The Unity is a national organization that was established in accordance to the law "About Nongovernment Organization (social Unites and Funds). The Unity acts on the basis of Constitution of Azerbaijan Republic, Legislation that is in force, international legal regulations that Azerbaijan republic support. The Unity is a non-government organization helping to strengthen supreme principal of law in the territory of Azerbaijan, to protect copyrights and connected rights, cooperating with national and international organizations in the sphere of law, taking an active part in all spheres of law. The Unity realizes some projects financed by International funds, including the projects named "Exit to Europe court on human rights" of "Eurasia " Fund. Since May, 20, 2002 "Advocate" legal service bureau acts attached to the Unity. In future the Unity has aimed to establish mass media, to issue books, journals, bulletins, etc. for spreading. On Friday and Saturday the Unity gives free juridical advice to invalids, refugees, movers, war participants, their families and martyr families. The Unity takes an educational experiment with the students of the faculty of Law. Some members of Unity took part in realizing the project named "Juridical Assistance Center of Non-government organization financed by "Eurasia" Fund and the project named "Learning environment of Non-government Organization" of UNHCR. It connected with several non-government organizations in Azerbaijan and American Lawyers Association.

PURPOSE AND DUTY OF UNITY

The aim of Unity is to achieve uniting of lawyers' effort on the formation of democratic- worldly, civilized society and help juridical enlightenment of society. The Unity realizes the following duties to achieve all the aims:

To improve, strengthen, defend and propagate supreme principal of law in the territory of Azerbaijan;

To help defense of copyrights and connected rights;

To aid refugees, movers and other population of little provided juridical;

To cooperate with non-government organizations, to help them juridical and informational;

To support spread of inquiry and investigation in the sphere of law or to collaborate with any national and international organizations having the same aims;

To help lawyers not to be involved in disagreement according to their orientation and make them unite around state, national and public interests;

To prepare and realize juridical measure programs for ensuring peace, public tranquility;

To try realization of human rights and liberties considered in Constitution of Azerbaijan Republic and other normative acts;

To propose improvement of juridical normative acts in democratic direction;

To help development of lawyers' specialty, professional experiences and activities;

ACTIVITY OF UNITY

The Unity realizes its duties in the following forms:

To prepare programs and conception with juridical enlightenment purpose and make proposals;

To hold seminars, scientific conference, competitions, public debates, etc.

To establish mass media and issue journals, books, bulletins for spreading according to the law;

To give juridical advice;

To support rights of physical and juridical persons in state, court and the other Jaw-defense organs according to the law;

To establish relations with analogical bodies in Azerbaijan and abroad;

To be engaged in other activities which are not forbidden by law;

MEMBERSHIP OF UNITY

In accordance to the legislation of Azerbaijan Republic each physical and juridical person who has work ability can be a member of Unity. State power and institutions of local government can't be a member of Unity. To be selected a membership to the Unity may be individual and collective.
Honorary members can also be selected to the Unity. Persons who want to enter the Unity to be a member should address the chairman of administrative personnel with an application in writing form. The application is looked through during a month after it is given. When most part of administrative personnel members bear a positive relation to this matter in voting, the applicant is considered to be elected a member to the Unity. At present Unity has more individual members than 50.

MANAGEMENT OF UNITY

Supreme organ of Unity is a general meeting that is called one time a year. To accept regulations of Unity and make changes in it, creation of executive organs and stopping of their power untimely, election of members, chairman of administrative personnel and control inspection commission, discussion and attending accounts of administrative personnel and control-inspection commission concern to the general meeting. The decisions about matters discussed in general meeting are accepted by vote. General meeting is called by the chairman of administrative personnel. Administrative personnel consists of chairman, their deputies and the other members who are elected by general meeting. Administrative personnel leads all the activities of Unity collectively during the period of general meeting, they supervise whether the activities of elective organs, office holders of Unity suit to regulations.

THE PROPERTY OF UNITY

There may be buildings, flats, plants, equipment, capital investments, shares, the other expensive
papers and another property considered by regulations of Unity for material maintenance of its activity
in the property of Unity. Money and the other formation sources of property of unity are as follows:

Means and endowment that the office, enterprises, organizations and citizens give voluntarily;

Project that the Unity got in the result of economic activity of enterprise;

Project received from exhibitions, concerts and the other measures;

Project received in the result of publication;

Prizes;

Another profits not forbidden by legislation

"ADVOCATE" JURIDICAL SERVICE BUREAU

"Advocate" Juridical Service Bureau was established attached to Social Unity "Society and Law" for showing paying juridical service. Bureau acts in accordance to the Constitution of Azerbaijan Republic, laws of Azerbaijan Republic, orders and disposals of Ministers cabinet of Azerbaijan Republic and regulations of Unity. Bureau has no juridical person status, it is non-independent structural part of Unity. Bureau arranges its activity on the basis of its financial principal. Activity of Bureau covers all the territories of Azerbaijan Republic.

MAIN DUTIES OF BUREAU

To show paying juridical service to juridical and physical persons;

As being structural part of Unity to fulfill other duties charged with it;

To support permanent development of Unity by its activity and getting profit;

FUNCTION OF BUREAU

To give advice and explanations concerned to juridical matters, to give written, oral testimonial references concerned to legislation;

To compile applications, complaints, agreements and other documents of juridical character;

To represent in the court (also in economic court)on matters concerned to civil work and administrative errors;

To take part in research, interrogation and court on criminal works as a defender of the harmful men, civil plaintiffs, civil defendants;

To organize and realize offended matters of juridical persons, to arrange preparation of materials concerned to the offended laws between institutions for giving to court organs, interrogation by customers' task;

To establish the library of legislation base, to realize the report about new legislation;

LAWS OF BUREAU

To address state organs, municipalities, social organizations and other juridical persons who are connected with the chairman of Unity for executing duties and functions indicated in the regulations, to interrogate necessary documents, information and other materials from them;

To involve independent experts, counselors and specialists by the chairman of Unity for fulfilling function;

To take measure for supporting broken rights of persons who have addressed for juridical defense and help;

ARRANGEMENT OF MATTERS OF BUREAU

Bureau is managed by the director who is appointed and dismissed from his post by chairman of Unity. The director of Bureau is personally responsible for executing duties and functions entrusted in Bureau. The director of Bureau has deputies who are appointed and dismissed from his post by chairman of Unity. Deputies of Bureau are elected from lawyers of Bureau. Authorities and functions of deputies are defined by chairman of Unity. Agreement concerned to the activity of Bureau are signed by the chairman of Unity. The chairman of Unity represents without warrant of attorney in the state and municipal organs of Bureau. Before someone are appointed as a director and deputy, management to the activity of Bureau are realized by the chairman of Unity.
